Terms of Service

These Terms govern the use of Pandus (the "Service"), provided by [ФОП legal name], a sole proprietor (ФОП) registered in Ukraine, tax number [tax number], address: [address] ("we", "us"). Contact: [e-mail].

1. What the Service is

1.1. The Service automatically checks web pages for accessibility issues against WCAG 2.2 level AA (the basis of the European standard EN 301 549), monitors sites on a schedule and produces reports.

1.2. The Service is an automated check, not a full accessibility audit. Automated tools detect only part of accessibility issues. A report does not confirm that a website meets any law or standard.

1.3. The Service does not provide legal advice. Drafts of accessibility information or statements are templates for review by your own lawyer.

2. Accounts

2.1. You must give accurate details and keep your login credentials secure. You are responsible for activity in your account and team.

2.2. The Service is not available to persons or organisations located in, or acting on behalf of, the Russian Federation or Belarus.

3. Acceptable use

3.1. Only check websites you own or are authorised to check.

3.2. Do not use the Service to overload, attack or probe websites or networks, to bypass access controls, or for any unlawful purpose. We may refuse or stop checks that look abusive.

4. Plans, prices and payment

4.1. Plans, prices and limits are shown on the pricing page at the time of purchase. Prices for subscriptions are charged in advance for each billing period.

4.2. Card payments are processed by our online reseller Paddle.com, which is the Merchant of Record for those orders and handles billing, taxes and refunds under its own Buyer Terms. Invoices for bank transfer are issued by us directly.

4.3. Subscriptions renew automatically until cancelled. You can cancel at any time; the plan stays active until the end of the paid period.

4.4. The Express report fee is credited towards a subscription started within 30 days of the purchase.

5. Refunds

Refunds follow our Refund policy.

6. Your content and data

6.1. You keep all rights to your content. You grant us the rights needed to provide the Service (for example, to fetch and analyse the pages you ask us to check and to store results).

6.2. We process personal data as described in the Privacy policy.

7. Availability and changes

We aim for high availability but do not guarantee uninterrupted operation. We may change features; material changes to these Terms are announced at least 14 days in advance.

8. Liability

8.1. The Service is provided "as is". To the extent permitted by law, we are not liable for indirect damages, lost profits, or for claims by third parties related to the accessibility of your websites.

8.2. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

8.3. Nothing in these Terms limits liability that cannot be limited by law, or the statutory rights of consumers.

9. Termination

You may stop using the Service at any time. We may suspend accounts that breach these Terms.

10. Law and disputes

These Terms are governed by the laws of Ukraine, without prejudice to mandatory consumer protection rules of your country of residence. We will try to resolve any dispute by contacting you first at [e-mail].
